PERB Files Complaint Challenges San Jose Pension Slashing Law

Less than a month after issuing a groundbreaking ruling against San Diego’s pension-slashing ballot initiative, the Public Employees Relations Board (PERB) has filed an action against a similar law in San Jose.

According to the PERB complaint, the San Jose City Council violated state law when it placed Measure B on the local ballot without proper meet-and-confer. The complaint also accuses San Jose of deliberately providing incorrect fiscal information to its unions, specifically San Jose Fire Fighters Local 230.

“We believe this to be a very positive action by the PERB that will benefit all San Jose employees,” said Robert Sapien, president of San Jose Fire Fighters.

The city has 20 days to respond to the PERB action, and is expected to disagree with the finding, likely triggering an administrative appeals process.

The complaint draws from a legal ruling issued last month by PERB declaring San Diego’s pension-slashing measure (Proposition B) illegal. That case is headed for appeal.
